Xét vì trong thời gian gần đây nhà cầm quyền cộng sản Việt Nam gia tăng đàn áp các nhân vật bất đồng chính kiến, những người đấu tranh cho dân chủ và nhân quyền, trắng trợn đàn áp Linh Mục Thaddeus Nguyễn Văn Lý tại Nhà Chung, thành phố Huế ngay trong dịp Tết cổ truyền năm Đinh Hợi 2007.

Xét vì nay nhà cầm quyền cộng sản Việt Nam lại tiếp tục leo thang trong những hành động dùng bạo lực chuyên chính vô sản để đàn áp những người trẻ tuổi tranh đấu dân chủ và nhân quyền ở Việt Nam, như:

- Hơn một tháng qua, chính quyền cộng sản Việt Nam đã điên cuồng tìm mọi cách để đàn áp các nhà dân chủ ở Việt Nam, mở đầu là ngày 3.02.2007, an ninh cộng sản tấn công bất hợp pháp vào Văn phòng luật sư Thiên Ân trong khi luật sư Lê Thị Công Nhân đang giúp cho một số sinh viên tìm hiểu về nhân quyền. Ngay trong đêm 3.02 an ninh cộng sản tiến hành khám xét Văn phòng, thu giữ tài sản và tài liệu cá nhân của luật sư Nguyễn Văn Đài. Chiều ngày 4.02 an ninh cộng sản lại tiến hành khám nhà luật sư Nguyễn Văn Đài và luật sư Lê Thị Công Nhân, thu giữ tài sản và tài liệu của cá nhân hai luật sư. Những ngày tiếp theo an ninh cộng sản liên tục triệu tập để thẩm vấn hai luật sư. Dưới sức ép của an ninh cộng sản, ngày 10.02.2007, Ban chủ nhiệm và đại diện Hội đồng khen thưởng kỷ luật của Đoàn luật sư Hà Nội đã mời luật sư Nguyễn Văn Đài đến làm việc vào ngày 12.02.2007. Hôm đó luật sư Đài có hẹn bác sĩ từ trước nên không tới. An ninh cộng sản cũng đã gây sức ép với Phòng đăng ký kinh doanh thuộc sở Kế hoạch và đầu tư Hà Nội để ra quyết định và thông báo thu hồi giấy chứng nhận đăng ký kinh doanh của Công ty TNHH Dịch thuật và Tư vấn Việt Luật vào ngày 28.02.2007, ông Nguyễn Văn Đài là một thành viên sáng lập và là giám đốc điều hành của công ty. Ngày 1.03.2007, Ban chủ nhiệm và Hội đồng khen thưởng kỷ luật của Đoàn luật sư Hà Nội viết giấy mời lần 2 để mời luật sư Nguyễn Văn Đài đến làm việc vào ngày 12.03.2007.

- Linh mục Nguyễn Văn Lý (60 tuổi), một trong những người sáng lập Khối 8406, và là người ủng hộ và giúp đỡ tích cực cho Đảng Thăng Tiến Việt Nam, đã bị một lực lượng hùng hậu hơn 60 công an cộng sản bắt tại Huế lúc 15h thứ 6 ngày 24.02.2007 sau 7 ngày giam giữ Linh mục Lý ngay tại căn phòng bé nhỏ của ông trong khu Nhà Chung thuộc Tổng giáo phận Huế, số 69 - đường Phan Đình Phùng. Ngày 18.02.2007 khi công an cộng sản VN đã ồ ạt đột nhập vào phòng riêng của Linh mục đập phá đồ đạc, lục lọi và tịch thu mọi phương tiện làm việc và liên lạc của Linh mục. Linh mục Lý đã tuyệt thực hoàn toàn từ đó cho đến gần đây (ngày 6.03.2007) để phản đối một cách bất bạo động việc làm tàn bạo và man rợ của c/s VN trong việc đàn áp đấu tranh dân chủ. Sức khỏe của Linh mục Lý đã suy giảm nghiêm trọng, huyết áp xuống thấp và giọng nói rất yếu. Khi công an cộng sản đến bắt giữ Linh mục, ông đã chống cự quyết liệt và đã bị khoảng 5, 6 công an trẻ to khỏe xông vào dùng bạo lực giữ chặt tay chân ông và lôi ông đi một cách rất thô bạo.

Vào lúc 10 giờ sáng (giờ Việt Nam) ngày 6.03.2007, một tốp công an cộng sản Việt Nam khoảng 15 người đã ập vào nhà riêng của luật sư Lê Thị Công Nhân ở số nhà 316, A7 khu tập thể Văn phòng chính phủ, ngõ 4 Phương Mai, quận Đống Đa, Hà Nội. Nhóm trưởng của toán công an này là Ngô Quang Du của Sở công an Hà Nội đã đọc lệnh bắt tạm giam 4 tháng đối với cô Lê Thị Công Nhân theo điều 88 Bộ Luật Hình Sự của nhà nước cộng sản Việt Nam. Một lúc sau chúng tôi lại nhận được tin luật sư Nguyễn Văn Đài đang bận công việc riêng của mình cũng đã bị một toán công an mật vụ cộng sản khác bám theo và ép buộc luật sư Đài trở về để cho họ khám xét nhà riêng (phòng 302-Z8 khu tập thể Bách Khoa, phường Bách Khoa, quận Hai Bà Trưng, Hà Nội) và văn phòng Thiên Ân (số 10 phố Đoàn Trần Nghiệp, phường Bùi Thị Xuân, quận Hai Bà Trưng, Hà Nội) của luật sư Đài. Tại văn phòng Thiên Ân, công an cộng sản đã lấy đi tất cả 5 bộ máy vi tính computer, mỗi bộ computer trị giá trên 8 triệu VNĐ, như vậy là lần này công an cộng sản Việt Nam đã đập phá tan hoang văn phòng Thiên Ân hơn cả lần trước vào đêm ngày 3.02.2007. Tại nhà riêng của luật sư Đài, công an cộng sản cũng tự ý lấy đi một máy điện thoại di động của ông, sau đó công an đọc lệnh bắt tạm giam 4 tháng đối với luật sư Đài giống như trường hợp của luật sư Lê Thị Công Nhân. Khi chị Vũ Minh Khánh là vợ của luật sư Đài yêu cầu công an cộng sản Việt Nam đưa lại biên bản tạm giữ đồ vật thì công an cộng sản đã từ chối, nói gia đình không được phép giữ biên bản đó (sic). Tất cả sự việc bắt tạm giam hai luật sư trên đây, công an cộng sản đã cho quay phim, và phát ngay trong bản tin thời sự trên đài VTV1 của nhà nước cộng sản lúc 19 giờ cùng ngày, vẫn với những luận điệu vu khống chụp mũ cho hai luật sư Đài và Công Nhân. Qua chuỗi sự việc trên, ta thấy rằng đây là một chiến dịch đàn áp nhằm vào những người có quan điểm bất đồng chính kiến và muốn thẳng tay trù dập những con người vì Lương Tâm này. Chính quyền cộng sản Việt Nam đã vi phạm nghiêm trọng Hiến pháp Việt Nam năm 1992 tại các Điều 68 về quyền tự do đi lại và cư trú ở trong nước, Điều 71 quyền bất khả xâm phạm về thân thể của công dân, Điều 73 quyền bất khả xâm phạm về chỗ ở của công dân. Đồng thời chính quyền cộng sản còn vi phạm một số điều trong Bộ luật Tố tụng hình sự như: Điều 6, 7,8 và vi phạm Điều 145 khi không giao cho người bị thu giữ 1 biên bản tạm giữ đồ vật. Chính quyền cộng sản Việt Nam đã vi phạm nghiệm trọng các Điều 9, 12, 17 của Công ước Quốc tế về các quyền Dân sự và Chính trị mà Việt Nam gia nhập ngày 24.09.1982.

Ủy ban Nhân quyền Việt Nam quyết định:

1/ Lên án những hành động trấn áp, bắt giữ và chiếm đoạt tài sản của chính quyền cộng sản Việt Nam nhằm vào văn phòng luật sư Thiên Ân và ban lãnh đạo của đảng Thăng Tiến Việt Nam và Khối 8406.

2/ Cực lực lên án và mạnh mẽ phản đối nhà cầm quyền cộng sản Việt Nam bắt giam hai luật sư Nguyễn Văn Đài và Lê Thị Công Nhân.

3/ Yêu cầu nhà cầm quyền cộng sản Việt Nam phải trả tự do ngay tức khắc và vô điều kiện hai luật sư Nguyễn Văn Đài và Lê Thị Công Nhân, đồng thời cũng chấm dứt ngay những hành động gia tăng sách nhiễu đàn áp phong trào dân chủ tại Việt Nam, văn phòng luật sư Thiên Ân, đảng Thăng Tiến Việt Nam và Khối 8406!

4/ Chúng tôi tha thiết kêu gọi cộng đồng quốc tế, cộng đồng văn minh tiến bộ, yêu chuộng hoà bình, tự do dân chủ trên toàn thế giới đồng thanh lên tiếng để ủng hộ và bảo vệ hai luật sư Nguyễn Văn Đài và Lê Thị Công Nhân, để bảo vệ những tiếng nói của Lương Tri con người.

5/ Kêu gọi chính phủ các nước, các tổ chức bảo vệ nhân quyền quốc tế, nhân dân khắp nơi trên thế giới và đồng bào Việt Nam ở hải ngoại hãy lên án mạnh mẽ chính quyền cộng sản Việt Nam khi họ tiến hành việc trấn áp, bắt giữ hai luật sư Nguyễn Văn Đài và Lê Thị Công Nhân.

DECLARATION

Whereas, in recent days the Vietnamese communist government has intensified its campaign to crack down on political dissidents and democracy and human rights advocates by blatantly raiding on Father Thaddeus Nguyen Van Ly's quarters in the Hue City Rectory during the traditional celebration of the Lunar New Year of the Boar (2007).

Whereas, the Vietnamese communist government has continued to redouble its efforts, resorting to proletarian dictatorship violence against young democracy and human rights activists in Vietnam, witness:

For over a month now, the communist government has frenziedly employed various tactics to repress democracy activists in Vietnam, beginning with its illegal raid on the Thien An law office on February 3, 2007, while attorney Le Thi Cong-Nhan was providing a group of college students with information on human rights. On the evening of the same day, security police conducted a search of the office and took away personal items and documents belonging to attorney Nguyen Van Dai. On the afternoon of February 4, the police proceeded with searching the homes of both attorneys Nguyen Van Dai and Le Thi Cong-Nhan, and confiscated more of their personal items and materials. In the following days, they continued to interrogate the attorneys. On February 10, under pressure from the police the Discipline and Commendation Board of the Hanoi Lawyers Association asked attorney Dai to report for a hearing, but Mr. Dai declined because of a previously arranged doctor's appointment. The police also pressured the Office of Business Registrar of Hanoi's Planning and Investment Bureau to issue a notice to cancel its license to the Translation and Legal Consultation, LLP on February 28, 2007, of which Mr. Nguyen Van Dai is a co-founder and the executive director. On March 1 st, the Discipline and Commendation Board of the Hanoi Lawyers Association sent another notice requesting Mr. Dai to report for a hearing on March 12.

Father Nguyen Van Ly, 60, a co-founder of Bloc 8406 and mentor of the Vietnam Progression Party, was arrested in Hue by a 60-policemen-strong force at 3 p.m. on February 24, 2007 after they had confined him to a tiny room inside the Hue Archdiocese Rectory at 69 Phan Dinh Phung Street. On February 18, as the police stormed into his room, ransacked his furniture and belongings, and confiscated his personal computers and mobile phones, Father Ly went on a hunger strike until today (March 6, 2007) in order to protest peacefully the violent and barbaric tactics the communist government has employed to muzzle political dissent. His health has deteriorated as his blood pressure is dropping and his speech is weak. Father Ly protested vigorously when five to six muscular policemen locked his arms and forcibly escorted him away.

On March 6, at 10 a.m. (Hanoi time) a group of 15 police stormed into the home of attorney Le Thi Cong-Nhan in a communal housing compound for government employees at 316, A7, Alley 4, Phuong Mai, Dong Da precinct, Hanoi. Mr. Ngo Quang Du, the police team leader of Hanoi's Police Headquarters, read to Ms. Cong-Nhan a warrant ordering her to be detained for at least four months pending investigation, as stipulated by Article 88 of the Criminal Code. A few moments later, the news came that secret service agents tailing attorney Nguyen Van Dai on the way to his office had turned him back, forcing him to join their search of his home (Apartment 302-Z8, Back Khoa Communal House, Back Khoa ward, Hai Ba Trung precinct, Hanoi) and the Thien An law office (10 Doan Tran Nghiep, Bui Thi Xuan ward, Hai Ba Trung precinct, Hanoi). The police took away from the law office a total of five desk computers costing eight million Vietnamese dongs apiece. On the second ransack, communist police did greater damage to the law office than on the first time on February 3. At Mr. Dai's home, after having confiscated his mobile phone, police read to him the same warrant as they did to Ms. Cong-Nhan. They flatly refused the plea of his wife, Vu Minh Khanh, for a receipt of confiscated items. Both arrests were videotaped by police, who then fed footage directly to the evening news broadcast on the same day on VTV1, a State-owned television station, which contained libelous charges against both attorneys.

In view of the above incidents, we strongly believe that the current campaign is aimed at violently repressing political dissidents and persons of conscience in Vietnam. The government's acts are in serious violation of the Vietnamese Constitution with regard to Articles 68 (freedom of movement,) 71 (inviolability of the citizen's body,) and 73 (inviolability of the citizen's domicile). Furthermore, the communist government has violated Articles 6, 7 and 8 of the Criminal Code, and in particular Article 145 that concerns receipts of confiscated items. They are also in serious violation of Articles 9, 12 and 17 of the International Covenant on Civil and Political Rights, ratified by the UN to which Vietnam became a signatory member on September 24, 1982.

The Committee for Human Rights in Vietnam hereby declares:

1/ That it condemns the Vietnamese communist government for having employed repressive tactics from arrest to seizure of personal properties when raiding the Thien An law office, as well as the headquarters of Bloc 8406 and the Vietnam Progression Party.

2/ That it vigorously denounces the Vietnamese communist government for having detained attorneys Nguyen Van Dai and Le Thi Cong-Nhan.

3/ That it urges the communist government to immediately and unconditionally release Father Nguyen Van Ly, and attorneys Nguyen Van Dai and Le Thi Cong-Nhan, at once stop all measures of harassment and repression against the democracy movement, namely the Thien An law office, the Vietnam Progression Party, and Bloc 8406.

4/ That it calls upon the international community of civilized, progressive, peace-loving people around the world to voice their unanimous support of the two attorneys, as well as other people of conscience in Vietnam.

5/ That it calls upon all governments, international human rights advocacy organizations, as well as the people, including overseas Vietnamese, all over the world, to strongly condemn the Vietnamese communist government for having arrested attorneys Nguyen Van Dai and Le Thi Cong-Nhan.

Considérant que dernièrement les autorités communistes vietnamiennes ont multiplié leurs répressions à l'encontre des opposants politiques, ceux qui militaient pour la démocratie et les droits de l'homme, persécuté publiquement le prêtre Jude Nguyen Van Ly au sein de l'archevêché de Hué en plein Nouvel An traditionnel Dinh Hoi 2007,
Considérant que ce régime continue encore aujourd'hui sa folle escalade de violence prolétarienne contre des jeunes militants de la démocratie et des droits de l'homme, notamment:
- Au début, le 3-2-07, la sécurité communiste a pris d'assaut illégalement l'étude d'avocats Thien An où l'avocate Me Le Thi Cong Nhan aidait un groupe d'étudiants à acquérir des notions de droits de l'homme. Dans la nuit de ce même jour la sécurité a procédé à la perquisition de l'étude, a confisqué divers biens et documents appartenant aux deux avocats. Les jours suivants elle les a convoqués quotidiennement pour interrogatoires. Sous la pression de la sécurité, le 10-2-2007 la Direction et la Délégation de la Commission des Promotions et Sanctions du Barreau de Hanoi convoquent Me Nguyen Van Dai pour une "séance de travail" pour le 12-2-2007 suivant. Comme Me Dai avait fixé rendez-vous ce jour-là avec son médecin, il ne s'est pas rendu à cette convocation tardive.

De même les services de sécurité du régime ont fait pression sur le Bureau de l'Enregistrement des Entreprises, relevant de la Direction du Plan et des Investissements de Hanoi, pour que le 28-2-2007 ce bureau décide et rende publique la décision de retirer le certificat d'enregistrement à la société TNHH de Traductions et Conseils juridiques, dont Me Dai était membre fondateur, sociétaire et directeur coordinateur. Le 1er-3-2007, la Direction des Promotions et Sanctions émet une deuxième convocation pour le 12-3-2007.

- Le père Nguyen Van Ly (60 ans), co-fondateur du Bloc 8406, sympathisant et défenseur actif du Parti pour le Progrès du Vietnam, a été arrêté à Hué par une force de police communiste d'une soixantaine d'agents à 15h le Vendredi 24-2-07, après sept jours d'assignation à domicile dans son petit appartement au Séminaire, dans l'enceinte de l'archevêché de Hué, No 69 rue Phan Dinh Phung. Le 18-2-07 à partir du moment où les policiers communistes se sont précipités pour envahir sa chambre individuelle et l'ont saccagée, fouillée et confisqué tous ses outils de travail et de communication, le père Ly a commencé une grève de la faim totale, et ce jusqu'à hier (le 6-2-07) pour protester de façon non violente contre ces agissements brutaux et barbares du communisme vietnamien pour réprimer la lutte en faveur de la démocratie. Sa santé s'est détériorée de façon inquiétane, sa tension artérielle est très basse et sa voix extrêmement faible. Lorsque les policiers l'avaient maîtrisé, il s'y était opposé avec fermeté et avait donc été brutalisé, immobilisé et traîné sans aménagement par 5 ou 6 agents grands et forts.

- A 10h (heure du Vietnam) le 6-3-07, un groupe d'environ 15 policiers a investi le domicile de Me Le Thi Cong Nhan au 316, A7 quartier collectif des Services du gouvernement, ruelle 4, rue Phuong Mai, arrondissement Dong Da, Hanoi. Le chef de ce groupe, M. Le Quang Du de la Direction de la police de Hanoi, a lu l'ordre de détention provisoire de quatre mois à l'encontre de l'avocate, selon l'article 88 du code pénal de l'Etat du Vietnam. A ce moment elle était seule à la maison et a pu prévenir sa mère Mme Tran Thi Le qui était à son travail. Peu après nous avons appris que Me Nguyen Van Dai, qui était en route pour des affaires personnelles, étai suivi par d'autres agents de police et obligé de retourner à sa maison assister à la perquisition de son domicile (chambre 302 Z8, immeuble collectif Bach Khoa, arrondissement Hai Ba Trung, Hanoi) et de son étude Thien An au 10 rue Doan Tran Nghiep, district Bui Thi Xuan, arrondissement Hai Ba Trung, Hanoi. Auparavant la police avait pris cinq ordinateurs valant chacun plus de 8 millions de VND (dong), servant au travail du personnel de l'étude. Ainsi la police communiste a-t-il presque tout saccagé dans cette étude, même davantage que dans la nuit du 3-2-07 passé. Au domicile privé de Me Dai, la police a aussi confisqué son téléphone mobile puis lui a lu l'ordre de détention provisoire de quatre mois, comme pour Me Le Thi Cong Nhan. A la demande de son épouse Mme Vu Minh Khanh, de lui délivrer un reçu pour les objets confisqués, la police a répondu que la famille n'avait pas le droit de conserver ce reçu (sic). Tous les événements précédents ont été filmés par la police vietnamienne et diffusés immédiatement après, dans le bulletin d'information sur la chaîne gouvernementale VTV1 à 19h du même jour, avec les argumentations calomnieuses habituelles sur les deux avocats en question. A l'heure actuelle Me Dai est détenu dans la chambre 17-19, prison No 1, Hanoi (le nouveau "Hanoi Hilton"), à 13 Km de Hanoi. Les deux avocats avaient bien entendu protesté contre ces arrestations arbitraires, illégales de la part de la police vietnamienne. Leurs familles respectives ne sont pas encore autorisées à les rencontrer, et la police leur a fait savoir qu'elles devraient passer par la police de district de leurs domiciles et obtenir son accord.

Au travers de ces faits on voit qu'il y a bien eu une vraie campagne de répression des opposants aux points de vue du parti, et de persécution de ces hommes et femmes doués de Conscience. Le régime communiste vietnamien a enfreint gravement les articles: 68, 71 et 73 de la constitution vietnamienne de 1992, respectivement sur la liberté de déplacement, sur l'inviolabilité de la personne physique et celle du domicile du citoyen. De même le pouvoir communiste vietnamien a transgressé des articles du code de procédures civil, à savoir: les articles 6, 7, 8 et 145 quand il a refusé de délivrer un reçu des objets confisqués.

Le régime vietnamien a violé gravement les articles 9, 12, 17 de la Convention internationale sur les droits civils et politiques à laquelle le Vietnam avait adhéré le 24-9-1982.
C'est pourquoi le Comité pour les Droits de l'Homme au Vietnam décide de:

1/ Condamner les actes de répression, d'arrestation et de confiscation de biens commis par le pouvoir communiste vietnamien contre l'étude Thien An, contre la direction du Parti du Progrès du Vietnam et contre le Bloc 8406;

2/ Exiger du régime vietnamien qu'il cesse immédiatement les actes similaires, qu'il libère les avocats Nguyen Van Dai et Le Thi Cong Nhan ainsi que le père Nguyen Van Ly, et leur restitue les biens confisqués illégalement;

3/ Condamner très fermement et protester de toutes nos forces contre l'arrestation des deux avocats Nguyen Van Dai et Le Thi Cong Nhan par le pouvoir vietnamien. Nous en appelons avec insistance à la communauté internationale civilisée, éprise de paix, de liberté et de démocratie pour qu'elle soutienne et défende les deux avocats Nguyen Van Dai et Le Thi Cong Nhan, et préservant ainsi des voix de la conscience humaine. Nous appelons tous les gouvernements, les organismes internationaux de défense des droits de l'homme, les peuples du monde et la communauté vietnamienne d'outre-mer à condamner fortement le régime vietnamien pour la répression contre eux et leur arrestation. Nous exigeons que le gouvernement vietnamien les libère sans délai et sans condition, et cesse immédiatement les actes chaque jour plus intenses de harcèlement et de persécution contre le mouvement démocratique au Vietnam, en l'occurrence contre l'étude Thien An, le Parti pour le Progrès du Vietnam et le Bloc 8406.
